LuxeBreed Boutique acts as a service platform providing curated selection, veterinary coordination, and international logistics for premium companion animals. The Customer acknowledges that they are the importer of record, and the Service Provider facilitates the process on their behalf.

2. GENERAL PROVISIONS
This GTC is available for reading on Service Provider’s web page at www.luxebreed-boutique.com. Service Provider shall file this GTC. This GTC shall be concluded only electronically by Customer’s explicit acceptance. This GTC shall be considered as a written agreement that is available and can be concluded only in English. Service Provider is not bound by any specific code of conduct.
This GTC shall apply to all electronic commerce services provided from the territory of Ukraine and used internationally through the web shop located on the www.luxebreed-boutique.com website (hereinafter "Website"). The GTC shall also apply to all commercial transactions carried out between Parties defined in this contract.
Purchases made in the web shop shall be regulated by the Law of Ukraine "On Electronic
Commerce", the Law of Ukraine "On Protection of Consumer Rights", and the Civil Code of Ukraine. For international transactions, Service Provider also acknowledges the principles of the Consumer Rights Directive 2011/83/EU where applicable to non-EU entities.
Customer may be any natural or legal person. Registration is not required for making a purchase. In the course of making a purchase, Customer shall accept this GTC and the Privacy Policy. By accepting the GTC and the Privacy Policy, Customer confirms familiarity with their content and agrees to be bound by them.
3. PRODUCTS TO ORDER
The web shop is engaged in facilitating the acquisition and international delivery of premium live dogs.
The Service Provider shall be responsible for providing the Customer with a standard pedigree for the dog, if a pedigree is advertised as included. If an export pedigree is requested and paid for by the Customer, the Service Provider is responsible for providing this document. The Service Provider shall endeavour to provide the Customer with the applicable pedigrees within a period of two to five months from the date of purchase. Please note that processing times by the relevant Kennel Clubs (e.g., FCI/UKU) are not within the control of the Service Provider, and the Service Provider shall not be liable for any delays caused by such organizations.
4. ORDERING PROCESS
4.1. Reservation
To initiate an order, the Customer proceeds to the selected puppy's page and, within the Payment block, selects a payment option: Deposit or Full Payment. Afterward, the Customer clicks the "Reserve Now" button, and the Website redirects the Customer to an SSL-encrypted checkout page (Shopify Checkout).
4.2. Checkout Stages
The checkout process consists of the following technical stages:

Stage 1: Identification. The Customer enters their email address and basic contact information.

Stage 2: Shipping and Services. The Customer enters/confirms shipping and billing details, selects an available shipping method, and may add optional LuxeBreed Boutique additional services (if displayed in the Checkout).

Stage 3: Pricing and Deposit. The Checkout system displays the total amount due (Total), including the price of the puppy, the selected shipping method, and additional services (if applicable). The Customer chooses one of the payment options previously selected in the Payment block:

Deposit – a non-refundable deposit of 750 EUR; or
-
Full Payment – immediate full payment. After selecting the payment option, the Customer clicks "Reserve Now" to proceed to completion and payment. If the Premium delivery option is displayed, its cost may be calculated individually and/or invoiced separately (as specified in the Checkout).

Stage 4: Agreement and Payment. The Customer is required to review and accept these Terms & Conditions and the Privacy Policy by checking the corresponding boxes (if available in the Checkout). Clicking the payment confirmation button directs the Customer to complete the transaction via the selected payment method available in the Checkout (e.g., credit/debit card, PayPal, Stripe, and/or other integrated methods).
4.3. Completion
Upon successful payment, the Customer receives an Order Confirmation at the email address provided during checkout. If necessary, the Service Provider may request additional clarification regarding billing details and/or delivery specifics.
4.4. Conclusion of Contract
The submission of an order by the Customer through the Checkout constitutes a binding legal offer to enter into a contract. The contract is considered concluded and legally effective from the moment the system confirms the order and/or an electronic order confirmation is sent to the Customer. The contract is concluded in English and shall be stored by the Service Provider for a period of two years.
4.5. Confirmation Timelines
The Service Provider undertakes to confirm the order and receipt of payment within 24 hours of the transaction (excluding technical delays by payment providers or force majeure events).
4.6. Data Accuracy
The Service Provider shall not be held liable for delays, failed deliveries, or additional costs resulting from the provision of incorrect or inaccurate data by the Customer during the checkout process.
5. PROCESSING ORDERS AND PERFORMANCE
5.1. Processing Hours: Orders are processed during business hours on weekdays from 08:00 to 19:00 (EET). Orders submitted outside these hours will be processed on the following business day.
5.2. Reservation & Availability: Upon order confirmation, LuxeBreed Boutique shall reserve the selected dog from the verified breeder. If the selected dog becomes unavailable before the finalization of the reservation, the Service Provider shall offer the Customer a "Priority Match" for an equivalent dog or provide a full refund of the amount paid within 14 days.
5.3. Veterinary Screening & Preparation: LuxeBreed Boutique shall collect the reserved dog for comprehensive veterinary screening according to our premium health protocol. The preparation period includes:
● Mandatory vaccinations and microchipping;
● Rabies antibody titration (if required by the destination country's regulations); ● Final "Fit-to-Travel" clinical examination.
5.4. Shipping Conditions: Delivery is initiated only if:
1. The dog is cleared by our veterinary experts as healthy and fit for transport;
2. All legal export/import requirements for the destination country (EU/Non-EU) are met;
3. The specialized pet transport (road or air) is confirmed.
5.5. Delivery Performance: Shipping is considered performed once the dog is handed over to the Customer at the provided shipping address (Door-to-Door) or at the designated airport. The Customer is responsible for being present at the agreed time to receive the dog.
5.6. Boarding Fees: LuxeBreed Boutique shall arrange shipping for the earliest legally possible date. If the Customer requests a delay or causes a delay in the scheduled transport, a boarding fee of EUR 25 per day shall be charged to cover premium housing, feeding, and care. Any additional shipping costs resulting from such delays shall be borne by the Customer.
5.7. Right to Reject: Service Provider reserves the right to reject an order at any stage if the dog does not meet our strict health and quality standards. In such cases, a full refund will be processed within 15 days.
5.8. Administrative Processing: To ensure compliance with EU veterinary standards, puppies may undergo final health certification and documentation processing through our designated International Administrative Hubs (including our partner facility in Romania).
6. PRICES
6.1. Price Composition: The price indicated as the TOTAL PRICE of the order shall mean the gross purchase price. It includes the purchase price of the dog, basic veterinary preparation, shipping cost, and any selected optional premium services (e.g., LuxeBreed Golden Shield).
6.2. Currency: All prices on the Website are indicated, and all transactions are processed exclusively in Euro (EUR).
6.3. Taxes and Duties: For international deliveries from Ukraine to the European Union or other jurisdictions, the Customer acknowledges that local import VAT and customs duties may apply according to the laws of the destination country. Unless specifically stated as a "DDP" (Delivered Duty Paid) service, these additional costs are the sole responsibility of the Customer.
6.4. Price Changes and Errors: LuxeBreed Boutique reserves the right to change prices at any time. Changes do not affect orders that have already been confirmed.
6.5. Payment Schedule and Methods:
● Deposit: A non-refundable deposit of EUR 750 is required at the time of submitting the order to reserve the dog.
● Balance Payment: The remaining balance of the Total Price (including the price of the dog, shipping, and any selected insurance options) shall be paid by the Customer using one of the following methods:
○ Bank Transfer: To the Service Provider’s bank details no later than 10 (ten) days before the scheduled shipping date;
○ Cash on Delivery: In cash (EUR) directly to the Service Provider’s representative or specialized courier upon the physical receipt of the dog.
6.6. LuxeBreed Golden Shield (Optional Insurance): The Customer may opt for a comprehensive insurance package at the checkout stage. If selected, the insurance fee is added to the Total Price. This package covers specific health guarantees and transit risks as defined in the "LuxeBreed Golden Shield" policy.
LuxeBreed Golden Shield™ Policy
This Policy is an integral part of the LuxeBreed Boutique General Terms and Conditions
(GTC). It governs the provision of extended guarantees and premium services for Customers who select the Golden Shield™ package during the checkout process.
1. Scope of Protection
LuxeBreed Golden Shield™ is a comprehensive security package designed to provide the Customer with peace of mind through three primary pillars of protection:
● Safe Transit Guarantee (Transit Risk Protection);
● Health Recovery Guarantee (14-Day Viral Protection); ● Genetic Integrity Guarantee (1-Year Hereditary Protection).
2. Safe Transit Guarantee
LuxeBreed Boutique assumes full financial and legal responsibility for the life and physical well-being of the dog until the moment of physical handover to the Customer.
● Risk Mitigation: In the event of transit-related injury, illness, or force majeure occurring during logistics, the Customer is entitled to a full refund of the Total Price or an immediate priority replacement with a dog of equivalent quality.
● Emergency Care: We cover all unforeseen veterinary costs incurred during transit to ensure the animal arrives in optimal condition.
3. Health Recovery (14-Day Viral Protection)
We stand behind our rigorous veterinary screening. This protection covers life-threatening viral infections, including Canine Distemper, Parvovirus, and Coronavirus Enteritis.
● Coverage: If a licensed veterinarian in the EU/destination country confirms a viral infection within 14 (fourteen) days of receipt, LuxeBreed Boutique will reimburse the cost of clinical treatment (up to 50% of the dog's purchase price) or offer a replacement.
● Reporting: The Customer must notify the Service Provider within 24 hours of the first symptoms and provide an official veterinary report.
4. Genetic Integrity (1-Year Hereditary Protection)
The Golden Shield™ includes a 1-year (one-year) guarantee against congenital or hereditary defects that significantly impair the animal's quality of life (e.g., severe hip dysplasia, congenital heart defects).
● Claims: Claims must be supported by a comprehensive report from a licensed veterinarian and, if requested, results from a certified DNA laboratory.
● Resolution: Upon verification of a genetic defect, the Customer is entitled to a partial refund (50-100% of the purchase price) or a replacement dog of the same class.
5. Care Concierge & Premium Support
Golden Shield™ holders receive exclusive access to our premium support ecosystem:
● 24/7 Priority Access: Direct line to a personal manager for the first 30 days post-delivery.
● Expert Consultation: One complimentary online session with a certified canine behaviorist or veterinarian to assist with the puppy’s adaptation in its new home.
6. Exclusions & Limitations
The LuxeBreed Golden Shield™ shall be deemed void or inapplicable in the following circumstances:
● Owner Negligence: Injuries or illnesses resulting from accidents, falls, or lack of supervision after handover.
● Improper Care: Health issues arising from poor nutrition, over-exhaustion, or failure to follow the provided care guidelines.
● Cosmetic Traits: The policy does not cover cosmetic features (e.g., eye color, coat shade, or slight bite irregularities) unless the dog was specifically sold as "Show-Class" with guaranteed traits.
● Mandatory Vet Check: Failure by the Customer to have the dog examined by a licensed veterinarian within 48 hours of receipt (as stipulated in the GTC) will result in the immediate forfeiture of the Golden Shield™ benefits.
7. Pricing & Activation
● The fee for the LuxeBreed Golden Shield™ is calculated based on the dog's value and is added to the Total Price at checkout.
● The Policy is activated only upon full payment of the Total Price and remains valid for the durations specified in each section above.
7. PAYMENT METHODS AND CONDITIONS
7.1. Order Confirmation: Upon confirming the Customer’s order, the Service Provider shall specify the TOTAL PRICE, which includes the purchase price of the dog, shipping, and any selected optional services.
7.2. Payment Methods: The Customer may pay the deposit or the full purchase price using the following methods:
● Digital Wallets: Apple Pay, Google Pay;
● Cryptocurrency: Supported assets via Coinbase Commerce;
● Bank Wire Transfer: To the Service Provider’s bank details; ● Cash on Delivery: Strictly for the remaining balance payment.
7.3. Date of Payment: The legal date of payment shall be the day when the funds are credited to the Service Provider’s account, confirmed by the payment gateway, or received in cash.
7.4. Balance Payment: The remaining balance (after the initial EUR 750 deposit) must be settled using one of the following options:
● Cash on Delivery: Paid in cash (EUR) directly to the Service Provider or authorized courier at the moment of physical handover of the dog;
● Pre-delivery Transfer: Paid via Bank Transfer, Digital Wallets, or Cryptocurrency prior to the handover.
7.5. Default and Deposit Forfeiture: Failure to pay the remaining balance at the moment of delivery (for cash payments) or prior to the handover (for digital methods) shall result in the immediate cancellation of the order. In such an event, the EUR 750 deposit shall be forfeited as non-refundable compensation for reservation, veterinary preparation, and boarding costs.
8. SHIPPING PRICES AND CONDITIONS
8.1. Informative Rates: Shipping prices and conditions are provided on the Website during the ordering process. The Customer acknowledges that indicated shipping rates (including air and specialized road transport) are informative. The Service Provider reserves the right to adjust these rates if changes in carrier pricing, fuel surcharges, or new international regulations occur. The Customer will be notified of any changes via email.
8.2. Carrier Selection: In cases of circumstances beyond the Service Provider’s control (e.g., airline cancellations, border delays, or logistical shifts), LuxeBreed Boutique reserves the right to switch to a suitable alternative premium transport provider to ensure the safe delivery of the dog.
8.3. Delays and Force Majeure: Any delay in the scheduled transport caused by factors beyond the Service Provider’s control (weather, customs processing, carrier technicalities) shall not be considered a breach of contract and does not entitle the Customer to a cancellation of the purchase or a return of the deposit.
8.4. Delivery Methods: The Customer may choose between specialized premium road transport (Door-to-Door) or Air Shipping to a designated airport. The Customer is responsible for being present at the agreed-upon time and location to receive the dog. The Customer shall cooperate fully with the Service Provider to facilitate a smooth handover.
9. RIGHT OF WITHDRAWAL
9.1. Personalized Service & Animal Welfare: In accordance with international consumer protection standards and the Law of Ukraine "On Protection of Consumer Rights," the Customer acknowledges that live animals selected and prepared based on individual needs are considered "personalized goods." Therefore, the standard right to withdraw without justification is strictly limited to protect the animal's welfare and cover the Service Provider's preparation costs.
9.2. Withdrawal Without Justification (Cancellation Windows):
● Within 24 Hours: The Customer may withdraw from the order without justification within 24 (twenty-four) hours following the payment of the deposit. In this case, the deposit shall be reimbursed to the Customer, minus an administrative fee of EUR 75.
● After 24 Hours: If the Customer withdraws more than 24 hours after paying the deposit but prior to the delivery, the EUR 750 deposit is strictly non-refundable and shall be retained by the Service Provider to cover reservation, boarding, and administrative expenses.
● Post-Full Payment: Once the Total Price is paid and the transport is scheduled, no withdrawal without justification is permitted.
9.3. Termination due to Contract Breach:
● General Rule: Either party may terminate the contract in the event of a significant breach by the other party.
● Service Provider Default: If the Service Provider fails to deliver the dog within 14 (fourteen) days of the agreed-upon date (excluding delays due to official regulations or force majeure), the Customer may terminate the contract and request a refund.
● Exclusions (Not a Breach): Minor variations in color, shade, or appearance compared to Website photos, or temporary conditions that do not affect long-term health, shall not be considered a breach of contract.
9.4. Health-Related Replacement: If, during the mandatory pre-shipping veterinary check-up, the dog is found to be unfit for travel for serious health reasons, the Service Provider shall exclusively provide the Customer with a replacement dog of equivalent quality. No monetary refund shall be issued in this case.
9.5. Returns Post-Handover: Once the Customer has taken possession of the dog, the Service Provider cannot reimburse shipping costs. Any costs associated with the return of the dog (if agreed upon by both parties) shall be the sole responsibility of the Customer.
10. INDEMNITY AND RESPONSIBILITY
10.1. Breed Awareness: By submitting the order, the Customer declares full familiarity with the specific characteristics, temperament, and requirements of the ordered breed. The Customer acknowledges that an animal's behavior is significantly influenced by the owner’s environment, training, and handling. The Customer assumes full responsibility for providing appropriate socialization and professional training at their own expense.
10.2. Liability for Damages: The Customer agrees to fully indemnify and hold LuxeBreed Boutique harmless against any claims for physical injury or material damage caused by the animal after the handover. Such incidents shall not constitute grounds for a refund, cancellation of the order, or any other monetary claims against the Service Provider.
10.3. Health & Allergies: The Customer acknowledges that any dog, including those marketed as hypoallergenic, may trigger allergic reactions or medical conditions in certain individuals. LuxeBreed Boutique shall not be held liable for any medical issues or allergic reactions arising from contact with the dog.
10.4. Finality of Agreement: The occurrence of behavioral challenges or medical sensitivities (such as allergies) after the dog has been received by the Customer does not entitle the Customer to a reimbursement of the purchase price, a return of the dog, or any other form of compensation.
11. ELECTRONIC CUSTOMER SERVICE AND COMPLAINT MANAGEMENT
11.1. Customer Support Channel: LuxeBreed Boutique operates an electronic Customer Service to manage feedback, investigate complaints, and provide support. The Customer Service is accessible at the following email address: puppy4delivery@gmail.com.
11.2. Complaint Investigation: The Service Provider shall investigate any received complaint without delay. If a resolution cannot be reached immediately, the Service Provider will document the complaint and provide the Customer with an official position regarding the case via email.
11.3. Response Timeline: The Service Provider shall provide a formal written response to any complaint within 30 (thirty) days of receipt. If a complaint is rejected, the Service Provider shall provide a detailed justification for the rejection.
11.4. Record Keeping: All complaint-related correspondence and resolutions shall be archived by the Service Provider for a period of 1 (one) year and shall be made available to the relevant regulatory authorities upon request.
12. PRIVACY AND DATA PROTECTION
12.1. Purpose of Processing: The Service Provider shall collect and store personal data received from the Customer exclusively for specific purposes: to perform the contract, facilitate delivery, and verify contract conditions at a later date.
12.2. Third-Party Disclosure: The Service Provider shall not disclose the Customer’s personal data to third parties, with the following exceptions:
● Payment Providers: To the card issuer or payment gateway (e.g., Hutko, Coinbase) to process the transaction;
● Subcontractors: To third parties acting as subcontractors (e.g., specialized couriers, veterinary services, or breeders) solely as required to fulfill the delivery and health protocols.
12.3. Legal Compliance: The Service Provider processes personal data in full compliance with the Law of Ukraine "On Protection of Personal Data". For Customers residing within the European Union, the Service Provider also adheres to the relevant principles of the General Data Protection Regulation (GDPR).

13. MISCELLANEOUS
13.1. Acceptance of Terms: By submitting an order, the Customer declares full familiarity with these General Terms and Conditions (GTC) and the Privacy Policy and acknowledges to be bound by them.
13.2. Breed Identity and DNA Clause: LuxeBreed Boutique provides puppies based on breed characteristics as identified by the breeders. The Service Provider does not provide, guarantee, or assume any responsibility for official pedigrees, registration papers, or lineage documentation from any Kennel Club or registration body (e.g., UKU/FCI). The absence of such documents shall not be considered a breach of contract. In the event of a dispute regarding the dog’s breed or identity, the only evidence accepted by the Service Provider is a DNA parentage test completed by authorized international laboratories. This test must include the puppy and both biological parents and shall be completed entirely at the Customer’s expense.
13.3. Technical Limitations: The Service Provider ensures that the Website meets modern security standards. However, the Customer acknowledges the technical limitations of the Internet. The Service Provider shall not be liable for damages resulting from connection issues, computer viruses, or software malfunctions beyond its direct control.
13.4. Intellectual Property: All content on the Website, including text, design, structure, and specifically the professional photographs of the animals, are the intellectual property of LuxeBreed Boutique. Any unauthorized reproduction or commercial use of these materials is strictly prohibited.
13.5. Force Majeure: The Service Provider shall not be liable for any failure to perform or delay in performance caused by events beyond its reasonable control, including but not limited to war, strikes, pandemics, or international transport blockades.
13.6. Severability: If any provision of this GTC is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.7. Governing Law and Jurisdiction: This GTC and the legal relations between the Parties are governed by the laws of Ukraine. Any disputes arising from this contract that cannot be settled peacefully shall be exclusively decided by the competent courts of Ukraine.
13.8. Biological Development and Natural Variation: The Customer acknowledges that the companion animal is a living organism. Its physical development, including but not limited to the timing of permanent teeth eruption, adult weight, and final size, is subject to individual biological variation and genetic expression. Such natural variations, developmental traits, or minor deviations from estimated adult characteristics shall not be considered a health defect, a genetic abnormality, or a breach of the Service Provider’s obligations.
